As used in this chapter:
DIRECTOR
Shall mean the Director of the Department of Engineering
and/or his or her designated agent.
INDIVIDUAL
Shall mean any individual, person, partnership, firm, association,
corporation, company, profit or non-profit organization of any kind.
SCHOOL
Shall mean any public or private school located within the
City of Newark.

a. Prohibition.
1. No City street or any portion thereof shall be closed to vehicular
traffic for the purpose of maintaining the public safety, health,
or welfare without meeting the requirements of this section and prior
approval by the Director.
2. No person shall operate a vehicle through a City street or portion
thereof where the street has been temporarily closed pursuant to the
requirements of this chapter.
b. Request to Close City Streets. Any individual may seek to have any
City street temporarily closed in order to protect the public safety,
health, and welfare. The Director shall review the request and determine
whether the City street or portion thereof should be temporarily closed.
c. Permission of the Director Required. Upon a finding that the closing
of a City street is necessary to protect the public safety, health
or welfare the Director may close any City street or portion thereof
to vehicular traffic on such day(s) or hours of any day to maintain
the public safety, health, or welfare.
d. Posting of Warning Signs. The Director shall post proper warning
signs in the street indicating that the street is closed and the time
of closing.
e. Rules and Regulations. Rules and regulations pertaining to the temporary
closing of any portion of any City street under this section shall
be promulgated by the Director and shall include but shall not be
limited to inspection of the proposed street closing, review by the
Division of Fire and Division of Police, notice to the general public,
reasonable fees for the closing and such other requirements to protect
the general public.
f. Penalty. Any person who violates the terms of this section or of
any regulations promulgated thereto shall, upon conviction thereof,
be punished by a fine not exceeding $50, or by imprisonment for a
term not exceeding 15 days or both.

a. Prohibition.
1. No City street or any portion thereof shall be closed to vehicular
traffic for the purpose of providing children with ingress and egress
to any school or recreational facility without meeting the requirements
of this section and prior approval by the Director.
2. No person shall operate a vehicle through a City street or portion
thereof when that street has been temporarily closed pursuant to the
requirements of this chapter.
b. Request to Close City Streets. The principal of any school may request
the Director to review the area surrounding any school for the safe
ingress and egress of children attending that school(s) and/or recreational
facilities and to close a street or portions thereof for the safe
ingress and egress of children.
c. Permission of the Director Required. Upon a finding of a safety problem
for ingress and egress, the Director may close any portion of any
City street within the block upon which any school is located to the
use of through traffic during the time as he/she shall determine,
not to exceed one hour between 7:30 a.m. and 10:00 a.m., two hours
between 11:00 a.m. and 2:00 p.m. and one hour between 2:30 p.m. and
4:30 p.m. on any day(s) upon which school is in session and to permit
the use of that portion of the street, during the hours designated
for ingress and egress to such school for the use by the pupils of
such school for recreational purposes under proper school supervision.
d. Barricades and Warning Signs. The principal of the school shall make
the necessary arrangements to provide and post barricades and warning
signs indicating that the street is closed, the time(s) of closing,
and the purpose therefor in compliance with the guidelines established
in the permit issued by the Director.
e. Rules and Regulations. Rules and regulations pertaining to the temporary
closing of any portion of any City street under this section shall
be promulgated by the Director and shall include but shall not be
limited to inspection of the proposed street closing, review by the
Division of Fire and Division of Police, notice to the general public,
and such other requirements to protect the general public.
f. Penalty. Any person who violates the terms of this section or of
any regulations promulgated thereto shall, upon conviction thereof,
be punished by a fine not exceeding $50, or by imprisonment for a
term not exceeding 15 days or both.

a. The Department of Engineering shall not grant any permit for street
closings unless the applicant, where practical, submit a copy of the
statement of concurrence with the proposed street closing signed by
the heads of not less than 51% of the households on the block or blocks
to be closed. The block or blocks may be closed between the hours
of 10:00 a.m. to 10:00 p.m.
b. All applicants seeking a permit for a street closing must be a resident
of the proposed block or blocks to be closed, excluding churches and
nonprofit organizations.
c. The Department of Engineering shall not grant any permit for street
closing on applications submitted less than 20 business days in advance
of the actual closing date, unless a nonrefundable late fee has been
paid.
d. The Department of Engineering shall submit all applications for street
closing to the Newark Department of Public Safety, Division of Police
and Division of Fire for their review and shall obtain a recommendation
prior to the granting of any permit for a street closing.
e. The Department of Engineering shall prepare all forms for the application
permit to be granted under this ordinance.
f. There shall be assessed a fee of $30 for the granting of each permit
to cover the expenses which shall be assessed and collected by the
Traffic Engineering Office of the City of Newark.
g. There shall be a $20 late fee assessed to applications submitted
after 20 business days have elapsed, to be collected by the Traffic
Engineering Office of the City of Newark.
h. There shall be a $20 refundable deposit per street barricade to a
maximum of $50. Deposit to be refunded upon return and inspection
of barricades by the Division of Traffic and Signals. Deposit to be
collected and refunded by the Division of Traffic and Signals.
i. No language contained herein shall be construed to, in any manner,
restrict or interfere with the partial or complete closing of a street,
where such closing is necessary for the proper function of any governmental
agency or public utility company. However, this in no way impairs
any licensing of other requirements presently imposed on said utility
companies.
