DIRECTOR
Shall mean the Director of the Department of Finance and/or his designee.
RETAIL FLORIST
Shall mean a business of selling at retail, cut flowers, growing flowers or plants, potteries, stands or holders containing plants or flowers.

No person shall engage in the business of retail florist, as defined in Section 8:13-1, without first obtaining a license for that purpose as hereinafter provided.

Any person desiring a license under this chapter shall file an application with the Division of Tax Abatement and Special Taxes on a form furnished by the Director. The application shall set forth the following information:
a. 
Name of applicant.
b. 
Business address at which the applicant proposes to conduct the business.
c. 
Character of the business and such other information as the Director may require.

The Director shall investigate or cause to be investigated each application and the truthfulness of the contents thereof.

After satisfactory investigation as required by Section 8:13-4, the Director shall issue the license.

a. 
The applicant shall pay a biennial license fee of $400 prior to the issuance of the license.
b. 
All licenses issued, and renewals thereof, under this chapter shall expire on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant's license will thereafter expire on March 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a retail florist's license.
c. 
The license fee shall be payable upon the presentation of the application and shall be returned less the sum of $15 in the event such license is not granted.

All licenses issued under the provisions of this chapter may be renewed annually by the Director subject in all things to the same conditions, provisions and charges as contained in and for the original license.

In addition to the penalty provided in Section 8:13-9, the license herein provided for may be suspended or revoked by the Director for the violation of any of the provisions of this chapter upon due notice and hearing.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
