(A) 
No appointed or elected official of the Borough serving with or without compensation and no person or firm with whom he or she is associated, including, but not limited to, the Borough Solicitor, the Borough Engineer and the Zoning Board Solicitor, shall provide, in return for a fee, professional services, to any person, partnership or other legal entity in connection with any enterprise requiring permission or approval of the Borough. However, nothing contained herein shall prevent such official from providing advice, given without compensation from the advisee, in accordance with the carrying out of his or her duties as a Borough official.
(B) 
No appointed or elected official of the Borough whose duties include the approval of proposals or plans of any project shall approve any proposals or plans of any project in which he or she has a financial interest.
(C) 
No appointed or elected official of the Borough whose duties include the inspection and approval of actual work done shall approve the work done on any project in which he or she has a financial interest.
(D) 
In case any appointed or elected official seeks the approval of any proposals or plans in which he or she has a financial interest or seeks the inspection and approval of any actual work done in which he or she has a financial interest, such appointed or elected official shall inform Council, in writing, of such financial interest and of his or her desire for inspection and/or approval. It shall then be the duty of Council to appoint, by resolution, a qualified individual to review any such proposals and plans and to inspect any actual work done and to make recommendations for approval or disapproval, as the case may be.

(A) 
There is hereby established in the Borough a classified service of Borough employees.
(B) 
Council shall, by resolution, from time to time classify various positions in the Borough as positions in the classified service according to the duties and responsibilities of each position. Such classification shall designate appropriate titles for each class of position and shall prescribe qualifications to be required of persons assigned or appointed to positions in each class. Such classification plan shall be so arranged that all positions which are substantially similar with respect to authority, responsibility and character of work are included within the same class, that the same tests of competency may be applied to persons to be appointed to all positions in a class and that the same schedule of compensation can be made to apply with fairness under like working conditions to all positions in a class.
(C) 
Any person holding any position in the Borough at the time of the adoption of this section (Ord. 372, passed August 1, 1977) shall retain such position and shall assume the classification title of such position, with all of the rights attaching to such position by reason of such classification.
(D) 
(1) 
Pursuant to Division (B) hereof, the following positions are hereby designated as positions in the classified service:
(a) 
Maintenance Supervisor;
(b) 
Borough Secretary; and
(c) 
Brookhaven Waste Water Treatment Plant Operator.
(2) 
The duties and responsibilities for such positions are as described in the attachment to original Res. 77-9, passed September 12, 1977.

(A) 
Whoever, being an appointed official, violates any of the provisions of § 280.01, shall be dismissed from service to the Borough and a replacement shall be appointed.
(B) 
Whoever, being an elected official, violates any of the provisions of § 280.01, shall be punished as provided in § 202.99.
