No person shall construct any new building or reconvert any old building for human habitation within the Borough without first submitting plans therefor to Council for approval.

The plans referred to in § 1222.01 shall be prepared in duplicate and shall show:
(A) 
The general layout of all proposed streets in the tract to be developed, if there is no presently opened and dedicated street, giving their alignment and location with reference to contiguous roads either actually existing or proposed;
(B) 
Profiles and grades of such roads;
(C) 
The course, structure and capacity of proposed water mains and sewers, together with profiles or grades, if required by Council;
(D) 
The method of drainage of the property and its relation to the drainage of adjacent or contiguous territory;
(E) 
Lot sizes;
(F) 
The location of proposed street lights;
(G) 
The location of proposed fire hydrants;
(H) 
The location of proposed curbs and sidewalks; and
(I) 
The width, length, profile, grade and type of construction of the road, street or lane.

Before acting upon the plans, Council may, at its discretion, arrange for a public hearing, after giving such notice as it may deem desirable in each case.

Council is hereby authorized to alter such plans and specify any changes or modifications of any kind, which it, at its discretion, deems necessary with respect thereto.

(A) 
Council shall not approve any such plan unless the applicant files a surety bond with the Borough, in such amount as the Borough Engineer certifies, to assure the completion of all the proposed improvements within a period of six months from the date of the approval of such plans, the form of such bond to be approved by the Borough Solicitor.
(B) 
Any person obtaining building permits under the provisions of this chapter shall be further required to post with the Borough either a cash bond or a bond with surety, acceptable to the Borough Solicitor, to guarantee the maintenance and repair of the streets for a period of two years from the completion thereof.
(C) 
The bond to guarantee the completion of all improvements in the development shall be in a sum equal to the estimated cost thereof. Such cost is to be computed by the Borough Engineer and reported to Council.
(D) 
The bond for maintenance and repair of the streets for a period of two years shall be in the sum of 50% of the original cost of all work, and the term of such bond shall commence from the date of final inspection and approval of the streets by the Borough Engineer.
(E) 
When streets, sewers, curbs, sidewalks and other improvements are ready to be accepted and declared ready for inspection by the developer, then the Borough Engineer shall make one free inspection. If work does not pass inspection, then all future inspections shall be paid for by the developer, the fee to be set by the Engineer.

When any such plan is approved by Council, it shall be signed in duplicate on behalf of the Borough by Council and an approved duplicate copy shall be filed with the Secretary of the Borough, who shall make the same available to public inspection.

After the applicant has had his or her plans approved, he or she shall thereupon apply to the Building Inspector for a permit to build in accordance with the provisions of the Building Code and other regulations of the Borough.

The Building Inspector shall issue no permit for building purposes unless and until the plans are approved as herein set forth.

(A) 
Any person opening new streets in the Borough for the purpose of developing the same in the erection and construction of dwelling houses or other buildings shall first submit to Council plans and specifications for street lighting on such streets.
(B) 
Upon approval of any such plans as submitted, such person shall cause to be erected all poles and wires for the purpose of lighting such streets at the sole cost of the applicant.
(C) 
Council shall not accept any deed of dedication for any new street in the Borough unless and until all street lighting has been approved, provided for, erected and constructed on such street.
(D) 
After the erection and construction of such street lights and acceptance of the streets by Council, the Borough shall assume all costs of maintaining the street lighting system.
