This chapter shall be known and may be cited as "The Highway and Sidewalk Ordinance of the Borough of Brookhaven" or just "the Highway and Sidewalk Ordinance."

All matters concerning the construction, placing, repair or alteration of any highway, street, curb or sidewalk, and the appurtenant structures thereof, within the dedicated width of the public highway, shall be considered within the scope of this chapter.

No highway, street, curb or sidewalk shall be constructed or altered within the Borough except in conformity with the provisions of this chapter and the Acts of Assembly of the Commonwealth in such cases provided. No highway, street, curb, sidewalk or part thereof, already existing or hereafter to be constructed in the Borough, shall be altered in any manner that would violate any of the provisions of this chapter or any rule promulgated hereunder.

No person shall open or excavate a street or highway between curb lines and property lines for repairs or work of any description, and no person shall alter, repair or construct a curb, highway, street, sidewalk, driveway or driveway entrance without first obtaining a permit for the same issued by the Building Inspector or another Borough officer designated by resolution of Council, upon a form prescribed by Council. Such permits shall be numbered consecutively and a record thereof shall be submitted to the Borough Auditors. All moneys received from such permits shall be remitted to the Borough Treasurer on or before the stated meeting after they are received. Such permits shall be in triplicate. One copy shall be given to the applicant, one copy to the Borough Secretary and the third copy retained permanently in the receipt book. The required permit shall be posted on the property upon which the work is being done and shall be available for inspection by an appropriate Borough representative when requested.

No person shall receive a permit issued under the provisions of this chapter without first making a written application therefor to the Building Inspector or other proper officer upon a form prescribed by Council, and paying all prescribed fees and costs. However, in an emergency, openings for repair of existing facilities may be made upon a verbal application to the Building Inspector, provided such verbal application is followed promptly by written application and payment of fees and costs as provided in this chapter.

Any permit issued under the provisions of this chapter shall be valid for a period of 30 days from the date of issue. If work is not commenced within 30 days and diligently pursued until completion, such permit shall, at the expiration of such 30 days, become null and void without any refund being made therefor. Thereafter, a new permit shall be required in the event that it is desired to proceed with the work contemplated in the voided permit. Such new permit shall be issued upon payment of an additional permit fee, but credit will be allowed for previous payment of other charges paid at the time of issuance of the voided permit.

(A) 
All curbs, sidewalks and driveways shall be constructed in accordance with specifications furnished or approved by the Borough.
(B) 
Portland cement concrete shall have a rating of 3,500 pounds per square inch (p.s.i.) and be certified by the supplier. (Adopting Ordinance)

All sidewalks constructed in the Borough shall extend from the curb line and shall be at least four feet wide.
(D) 
All sidewalks and driveway aprons within the apron itself shall be six inches thick and include wire reinforcing.

Openings in the roadways of state highways shall require permits from and be subject to regulations and requirements of the State Department of Transportation. Openings between curb lines and property lines on state highways for repairs, construction or work of any description shall be subject to the provisions of this chapter. However, in the case of service lateral trenches that are a continuation of openings in roadways of state highways, a Borough permit will not be required.

The Code Enforcement Officer or Building Inspector shall periodically inspect the sidewalks and curbs within the Borough, and shall order the necessary repairs as hereinafter provided.

The Borough Engineer shall furnish, at the expense of the property owner, all required lines and grades for any repairs, alterations or construction of any sidewalk or curb. Such work shall not be commenced without such required lines and grades. A plan and profile of any work contemplated upon any street or highway not now improved shall be submitted to Council, which shall authorize the Engineer to establish lines and grades thereof.
