The Borough hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210.101 through 7210.1103, as amended from time to time, an its regulations.

(A) 
The Uniform Construction Code, contained in 34 Pa. Code Chapters 401 through 405, as amended from time to time, is hereby adopted and incorporated herein by reference as the municipal building code of the Borough.
(B) 
The following list of appendices of the various codes which comprise the Uniform Construction Code are also specifically adopted by the Borough:
(1) 
International Building Code — Appendices A, C, and F through J;
(2) 
ICC Electrical Code — Not applicable;
(3) 
International Mechanical Code — Appendices A and B;
(4) 
International Fuel Gas Code — Appendices A through D;
(5) 
International Plumbing Code — Appendices A through G;
(6) 
International Residential Code — Appendices A through L;
(7) 
International Fire Code — Appendices B, C, D, E, F and G;
(8) 
International Energy Conservation Code — Not applicable;
(9) 
International Existing Building Code — Appendices A and B; and
(10) 
International Urban-Wildland Interface Code — Appendices A through H.

Administration and enforcement of the Code within the Borough shall be undertaken in any of the following ways as determined by the Borough Council from time to time by resolution:
(A) 
By the designation of an employee of the Borough to serve as the Municipal Code Official to act on behalf of the Borough;
(B) 
By the retention of one or more construction code officials or third party agencies to act on behalf of the Borough;
(C) 
By agreement with one or more other municipalities for the joint administration and enforcement of this Act through an intermunicipal agreement;
(D) 
By entering into a contract with another municipality for the administration and enforcement of this Act on behalf of the Borough; and
(E) 
By entering into an agreement with the Pennsylvania Department of Labor and Industry for plan review, inspections and enforcement of structures other than one-family or two-family dwelling units and utility and miscellaneous use structures.

A Board of Appeals shall be established by resolution of the Borough Council in conformity with the requirements of the relevant provisions of the Code, as amended from time to time, and for the purposes set forth therein. If at any time enforcement and administration is undertaken jointly with one or more other municipalities, said Board of Appeals shall be established by joint action of the participating municipalities.

(A) 
All building code ordinances or portions of ordinances which were adopted by this municipality on or before July 1, 1999, and which equal or exceed the requirements of the Code shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the Code, as amended from time to time.
(B) 
All building code ordinances or portions of ordinances which are in effect as of the effective date of this ordinance and whose requirements are less than the minimum requirements of the Code are hereby amended to conform with the comparable provisions of the Code.
(C) 
All relevant ordinances, regulations and policies of this municipality not governed by the Code shall remain in full force and effect.

Beginning on the effective date of this chapter, no applications for permits governed by the Act, the Code and/or this chapter relating to commercial, industrial, institutional, educational and all non-one- or two-family residential new construction or major renovations or work (for purposes of this section, the term MAJOR shall be defined as in excess of $1,000 in total cost) shall be considered complete until applicant has provided the Borough with a written review of the plans by BOCA International, or its successor organization.

Fees assessable by the Borough for the administration and enforcement undertaken pursuant to this chapter and the Code shall be established by the governing body by resolution from time to time. In addition to any other fees, the Borough shall assess a fee of $2 on each construction or building permit issued under the authority of the Act and Code, which moneys shall be transmitted quarterly to the Pennsylvania state treasury as required by § 703 of the Act.

(A) 
The Borough hereby determines that it is in the best interest of the general health, safety and welfare of Borough residents to require building permits for certain utility and miscellaneous use structures.
(B) 
Act 93 of 2004 permits the Borough to enact ordinances pursuant to that section which adopt stricter code requirements than required by the Code for the regulation of utility and miscellaneous use structures.
(C) 
Building permits shall be required for all utility and miscellaneous structures having a building area in excess of 120 square feet in size, including carports, detached private garages, greenhouses and sheds. Building permits shall also be required for all utility and miscellaneous use structures having a building area less than or equal to 120 square feet which will have any electrical, plumbing or other utility connection.
(D) 
No property owner shall erect or allow the erection of any utility or miscellaneous use structure in violation of this section, including carports, detached private garages, greenhouses and sheds without first obtaining a building permit therefore.
