(A) 
Prohibiting Sales To A Minor: It shall be unlawful for any person, whether acting individually, as an owner, officer, employee, or agent of or on behalf of any person, to sell, buy for, distribute samples of, furnish, exchange, or give away any products containing ephedra, alkaloids of ephedra, any other products exempted by Chapter 720 of the Illinois Compiled Statutes, Section 570/216, and any products marketed as dietary supplements containing such items to any individual under the age of 18 years.
(B) 
Display Of Such Products: It shall be unlawful for any person or business, whether acting individually or as an owner, officer, employee, or agent of or on behalf of, any person, to display, for sale, any product containing ephedra, alkaloids of ephedra, any other products exempted by Chapter 720 of the Illinois Compiled Statutes, Section 570/216, and any products marketed as dietary supplements containing such items in any place of business except behind the sales counter of such business, out of immediate reach of customers of such businesses or entities.

The following definitions shall apply to the interpretation and enforcement of this chapter:
EPHEDRA CONTAINING PRODUCTS
Any product marketed or sold as containing ephedra or an alkaloid or derivative of ephedra.
EPHEDRINE
Any product marketed or sold which contains ephedrine as a dietary supplement, energy enhancer, or mental alertness product.
PRODUCTS EXEMPT UNDER 720 ILLINOIS COMPILED STATUTES 570/216
Any product marketed or sold pursuant to the exemptions contained under said Illinois statute.

(A) 
Fines: A violation of Subsection 3-19-1(A) or (B) of this chapter shall be punishable by a fine not less than $100 nor more than $400 for the first offense and not less than $400 nor more than $750 for a second or any subsequent offenses.
(B) 
Special Fund: One-half of all fines and penalties received under Subsection (A) of this section shall be placed in a special fund. The fund shall be used as directed by the City Council from time to time for the prevention of abuse of the products herein restricted by minors and others within the City. The remaining 1/2 of said money shall be deposited in the City police fund.

If any section, paragraph, clause, or provision of this chapter or the application thereof to any person or circumstance is held invalid by a court of competent jurisdiction, the remainder of this chapter or the application of such section, paragraph, clause, or provision to persons or circumstances other than those to which this is held invalid, shall not be affected thereby.
