This Title Three of Part Thirteen shall be known and may be
cited as "the New Castle Zoning Ordinance of 2009," and is referred
to herein as "Zoning Ordinance."

From and after the effective date of this section, the use of
all land and every building or portion of a building erected, structurally
altered or added to, or relocated, and every use within a building
or use accessory thereto, in the City of New Castle, shall be in conformity
with the provisions of this Zoning Ordinance.

This Zoning Ordinance is adopted for the following purposes:
(a) To promote, protect and facilitate the following: the public health,
safety, morals, general welfare, coordinated and practical community
development, proper density of population, the provision of adequate
light and air, police protection, vehicle parking and loading space,
transportation, water, sewerage, schools, public grounds and other
public requirements.
(b) To prevent the following: overcrowding of land, blight, danger, and
congestion in transportation, loss of health, life or property from
fire, flood, panic or other dangers.
(c) To implement the New Castle Comprehensive Plan dated 2005.

All ordinances or parts thereof conflicting herewith and the
same are hereby repealed, specifically Title Three - Zoning Ordinance,
of the Codified Ordinances of the City of New Castle, PA-Ordinance
No. 6682 of February 7, 1979, as amended.

If any section, paragraph, subsection, clause or provision of
this Zoning Ordinance shall be declared by a court of competent jurisdiction
to be invalid, such decision shall not affect the validity of this
Zoning Ordinance as a whole or any part thereof.

This Zoning Ordinance is designed to:
(a) Support and encourage order and beauty in the development of the
City's environment for the convenience and pleasure of present
residents, and future residents through sound land development practices
and the provision of adequate public utilities and facilities.
(b) Protect the integrity of existing residential areas.
(c) Protect existing and proposed industrial areas to insure the economic
stability of the New Castle area.
(d) Protect and provide for existing and future commercial areas within
the City.

This Zoning Ordinance shall take effect on December 3, 2009.
