Unless granted a special permit to do so by the Director of
Code Enforcement, no person shall throw, store or accumulate, or cause
to be thrown, stored or accumulated, any waste matters, discarded
or unused materials, articles or things in any open yard or public
place within the City.

No person, being the owner, tenant or person in charge of any
lot, piece or parcel of land within the City shall allow any waste
matters, discarded or unused materials, articles or things to be thrown,
stored or accumulated on their land or in the streets, alleys and
public places adjacent thereto or abutting thereon, without first
obtaining a special permit from the Director of Code Enforcement.

No person, who has obtained a permit to store or accumulate
within the City any waste matters, discarded or unused materials,
articles or things in any place within the City, shall store or accumulate
any such things, which are not securely enclosed by fences or walls,
the doors and gates to which are kept closed at all times so as to
prevent children or other persons wandering therein.

(a)
Whenever a hazardous condition is created by the deposit, injection,
dumping, spilling, leaking or placing of a hazardous waste or substance,
so that the hazardous substance or waste or a constituent of the hazardous
waste or substance may enter the environment or be emitted into the
air or discharged into any waters, including ground water, the person
responsible for the hazardous waste or substance or for the hazardous
condition shall cause the condition to be remedied by a clean up as
rapidly as feasible to an acceptable, safe condition.
(b)
The costs of clean up shall be borne by the person having control
over the hazardous substance. If the person having control over a
hazardous substance does not cause the clean up to begin in a reasonable
time in relation to the hazard and circumstances of the incident determined
by the City, the City may proceed to procure clean up services and
to bill the cost of such clean up services to the responsible person.
(c)
If the cost of such clean up services is not paid within 30 days,
the City Solicitor shall proceed to obtain payment by all legal means.

Whoever violates any provision of this article shall be punished
as provided in Section 101.99 of the Administrative Code. Any violation
of this article on any day shall be considered as a separate and distinct
offense from any violation thereof on any other day.
