As used in this article, certain terms are defined as follows:
(a) 
LARGE ANIMALS — All individual species of the bovine (Bovidae), equine (Equidae), and swine (Suidae) families.
(b) 
SMALL ANIMALS — Felines (Felidae), rabbits, hares, guinea pigs, chinchillas, hamsters, pigeons (except homing pigeons), rats and mice, except as provided in Section 1145.10.
(c) 
KEEPER or PERSON — Any person, firm or corporation owning or actually keeping, having, using or maintaining any of the animals herein referred to.
(d) 
PERSON — Any individual, firm or corporation.
(e) 
PERMIT — The permit issued by the City Clerk upon approval by the Code Enforcement Officer.
(f) 
RATPROOF — A state of being constructed so as to effectively prevent entry of rats.
(g) 
SANITARY — Any condition of good order and cleanliness, which precludes the probability of disease transmission.
(h) 
CODE ENFORCEMENT OFFICER — The Director of the Department of Code Enforcement or his authorized agents.

No person shall keep, own, maintain, use or have in their possession any animals as defined in this article, within the corporate limits of the City, except that such animals may be kept under the conditions hereinafter set forth, provided a permit is first obtained.

A permit is required as a prerequisite to the keeping, owning, maintaining, using or having possession of any animals as defined in this article, and may be obtained from the City Clerk. Application for such permit shall be filed with and approved by the Code Enforcement Officer, who shall only approve the application after determining that the applicant for such permit complies with all requirements for such permit as set forth in this article.

There shall be two classifications of permits that may be issued under the provisions of this article as follows which permits shall expire December 31 of each year:
(a) 
Permit for keeping of small animals, the fee for which shall be $25 per year or any fraction thereof. No permit or fee shall be required if the small animal is housed in any dwelling, providing the total number of small animals does not exceed three.
(b) 
Permit for keeping of large animals, the fee for which shall be $100 per year or any fraction thereof.

No permit shall be issued or be valid if issued for the permitting or keeping within the City of a total of more than two large animals.

(a) 
Permits for the keeping of large animals shall be issued only to those applicants who provide facilities for the keeping of such large animals in quarters set out herein, which will confine such large animals within limits not closer than 250 feet to the exterior limits of any dwelling resided in by anyone other than the applicant, unless such other building is owned by the applicant.
(b) 
Permits for the keeping of small animals shall be issued only to those applicants who provide facilities for keeping of such small animals in quarters set out herein, which will confine such small animals within limits not closer than 25 feet to the exterior limits of any dwelling resided in by anyone other than the applicant.

(a) 
Upon obtaining a permit from the City Clerk as provided in Section 1145.03, every keeper of an animal shall comply with the following requirements:
(1) 
Confine the animal in an enclosure sufficient to prevent its running at large, maintain such enclosure in a clean and sanitary condition at all times, and use an approved insecticide as often as deemed necessary by the Code Enforcement Officer.
(2) 
Provide a shelter or area of a size sufficient to be conducive to good sanitation practices and provide adequate and sanitary drainage for such shelter or area.
(3) 
Cause the animal litter and droppings therefrom to be collected daily in a container or receptacle of such type that when closed it is ratproof and flytight, and after each such collection cause such container or receptacle to be kept closed. At least twice a week, cause all litter and droppings so collected to be disposed of in a way so as to prevent the presence of fly larvae.
(4) 
Cause all feed to be stored and kept in a ratproof, flytight building, box, container or receptacle.
(b) 
The failure of any keeper of any animal to comply with the provisions of this article or the sanitation standards and requirements established by the Code Enforcement Officer shall be cause for such Officer to revoke or refuse to approve issuance of such permit. The decision of the Code Enforcement Officer shall be subject to review by Council if the applicant or permittee feels such permit refusal or revocation to be unjustified.
(c) 
The premises shall be subject to inspection by the Code Enforcement Officer at any reasonable hour of the day.

Dogs licensed as required by other laws or ordinances are exempt from the permit and permit fee as required by this article, but where more than two dogs are kept, all other provisions of this article, applicable to small animals, shall be complied with.

It shall be the duty of the permittee to maintain and operate the housing and keeping of any animals in such a manner as not to create a nuisance as determined by any court of competent jurisdiction.

Medical laboratories, educational institutions, veterinary hospitals, pet shops or other similar activities shall keep and maintain animals under the same conditions as are prescribed by this article and with the same distance and structural requirements herein set forth. Permits for these types of institutions shall not be issued unless full compliance with the Zoning Ordinance has first been met.
Whoever violates any provision of this article or fails to comply with any provision or order made thereunder, within a fixed time, shall severally, for each and every such violation or noncompliance respectively, be punished as provided in Section 101.99 of the Administrative Code.
